TERMS AND CONDITIONS

The following terms and conditions are entered into between, on one hand, the company Lecyclo.com and, on the other hand, any person wishing to make a purchase (« the customer ») via the web site www.lecyclo.com . The present web site www.lecyclo.com (« the web site ») is edited by Lecyclo.com, registered in the Register of Companies , which head office is located 49-51 rue Samatan - 13007 Marseille.

The present general conditions are applicable to all sales of goods presented on the web site being heard that these offers are reserved for private individuals of more than 18 years.

Article 1 :Sale and order

The present conditions of sales give whole obligations to the 2 parts. The customer accepts without any reserve the whole dispositions that are taken in these Sales conditions. No condition given by the customer can be integrated to these present conditions since the documents can be incompatible with the present sales conditions. The present sales conditions define the rights and obligations of the two parts for the on-line sales offered by the company Lecyclo.com to the customer.

Article 2 : Contractual documents

The present contract is formed by the following documents, presented in order of importance : the order form, the present sales conditions. In case of contradiction between the documents, the dispositions of the superior one will prevail over the other one's dispositions.

Article 3 : Effect - Duration

The present sales conditions are valid since de date of the signature of the order form and will be effective during the time which is necesary to provide the goods ordered, to the end of the warranties given by the company Lecyclo.com.

Article 4 : Electronic Signature

  The double click of the customer on the order form constitutes an electronic signature that has, between the two parts, the same worth than a manual signature.

Article 5 : Order confirmation

The contractual informations will be confirmed by an e-mail with all details about the order(price, delivery modalities), in the most later case at the reception of the goods by e-mail, or in default at de shipping address indicated by the customer in the order form.

Article 6 : Transaction proof

The computerised registers, conserved in Lecyclo.com informatic system in good conditions of security, will be considered as communication proofs, of orders and payments made between the two parts. The filing of order forms and invoices is made on a reliable and enduring support than can be produced as a proof.

Article 7 : Informations on the products

7-a : The company Lecyclo.com presents on its web site the products to sell with the necesary caracteristics to respect the Article L 111-1 of the Code de la consommation, which informs the potential customer before the order, the essential caracteristics of the products he wants to buy.
7-b : The offers presented by the company Lecyclo.com are valid in the limit of available stocks.

Article 8 : Price

The prices are indicated in Euros and are valid until the day the customer sends the order form to Lecyclo.com. They don't include shipping fees, which are indicated before the validation of the order and billed as an extra. The prices take account of VAT applicable the day of the order and every change of the VAT rate will be automatically reflected on the price of the products of the on-line shop. Payment of the whole price must be done at the time of the order. The amount deposited cannot be considered as money down.

Article 9 : Method of payment

To pay his order, the customer can choose one of the payment methods given in the order form: bank card(Visa, MasterCard), bank transfer. The customer garanties to Lecyclo.com that he has the necesary autorisations to use the payment method he chooses when he validates the order form. The company Lecyclo.com is entitled to stop every order or every shipping in case of refused autorisation of payment by credit card from the oficially acredited organisms or in the case of a non payment. Lecyclo.com is entitled to make a shipping or to refuse an order from a customer who has not payed totally or partially a precedent order or with whom a payment litigation could be in course. Lecyclo.com has put in place a process of verification of the order to assure that nobody can use the bank datas of another person. Aiming to this verification, the customer will have to send by fax to the company Lyclo.com a copy of an identity paper and an address justification. The order will be valid only after reception and anlyse by us of these informations.

Article 10 : Availability of the products

The order must be handled in a delay of 3 days after the customer's order. In case of unavailability of the ordered product, the customer will be informed the most quickly and can then cancel his order. Then,the customer will have the choice between asking for payback of the amount given (in a delay of 30 days after the payment), or to change the product.

Article 11 : Shipping modalities

The products are delivered at the address indicated by the customer on the order form. The customer has to verifiy the good condition of the packing on delivery and to report the damages due to transport on the delivery order, and to Lecyclo.com, in a delay of 1 week. The customer can, if he asks for, obtain the shipment of the invoice at the invoice address instead of the shipping adress. For the shipment, we work essentially with Colissimo Suivi. Since we make a shipment, you immediately receive a mail to informe you. For shipping out of France, the customer undertakes all importation taxes, custom duties and VAT applicable in the country he receives the order.

LA POSTE

To reduce shipping fees, all the products with a low glut are shipped by La Poste Colissimo Suivi. This company delivers in 48H in whole France and gives you the possibility to reclaim the products at the closest post office of your shipping address if you are not present on the first visit of the postman. Colissimo Suivi is a very reliable service. However, it is posible, as in every shipment, to have a shipping delay or to lose the porduct. In case of delay in comparison with the indication in mail date, please report this delay by contacting Lecyclo.com by phone or e-mail. Then we will contact la Poste to begin an inquest. It can last up to 21 days since the start date. If during this delay, the product is recovered, it will be transported immediately to your shipping address (the most cases). If, on the contrary, the product is not recovered at the end of the delay, la Poste considers the packing as lost. It is only at that moment that we can send you another product at our fees. If the product is out of stock at this moment, we will reimburse you the price of the lost product. If the product is available but we have changed its price on the web site, we will apply the new sale price reimbursing you the difference or asking for a payment. We decline every reponsability about delays of shipping caused by the freight operator, notably in case of strikes.

Article 12 : Problem shipping due to the freight operator

Every problem concerning the shipping (damages, missing product in comparison with the delivery order, broken products) must imperatively be indicated on the delivery order manually, with the customer's signature. The customer must confirm this problem send to the freight operateur a certified mail in the 2 days following the delivery date explaining the same problems. The customer must transmit a copy of this mail to our Customer Departement.

Article 13 : Delivery mistakes

13-a : The consumer must notify to Lecyclo.com the same day of the delivery or at latest, the following day of the delivery, every complaint due to the shipping and/or a non conform product in comparison with the indications that are on the order form. Every complaint made after this delay will be rejected.
13-b : This complaint to the company Lecyclo.com can be done by telephone at +33(0) 4 86 77 80 90 from monday to friday from 9h to 12h.
13-c : Every complaint that will not respect these conditions will not be accepted by Lecyclo.com and will free Lecyclo.com up from its responsabilities
13-d : Receiving the complaint, the company Lecyclo.com will give an exchange number for the concerned products and will give this number by e-mail, fax or telephone to the customer. The exchange of a product cannot be done without the attribution of this number.
13-e : Every product that must be exchanged or reimbursed must be send to Lecyclo.com complete and in its complete packing by Colissimo Recommandé.

The shipping fees are on the charge of Lecyclo.com except if the problem doesn't coincide with the original declaration made by the consumer on the return order.

Article 14 : Warranty of products

In accordance with the Article 4 of the decreet n°78-464 of 24 march 1978, the dispositions of the presents cannot deprive the customer to have the legal warranty that complies the seller to warranty him against all the latent defect of the sold item. The customer knows that Lecyclo.com is not the manufacturer of the products that are presented in the website, in the sense of the law n°98-389 of 19 may 1998 which deals with responsability for defect products. Consequently, in case of damages caused to a person or a good by a defect of the product, the only responsability of the manufacturer can be researched by the customer, with the informations that are given on the packing of the products.

Article 15 : Right of revocation

The customer disposes of a period of 7 workable days to return at his own fees the products that are not convenient to his needs. This period begins since the delivery day. Every returned product must be reported previously to the Customer Department of the company Lecyclo.com by phone at +33(0) 4 86 77 80 90 from monday to friday 9h to 12h. The product must be returned by Colissimo Recommandé to Lecyclo.com, 49-51 rue Samatan 13007 Marseille. Electronic products stay refering to the legal period of 7 days for revocation. Every damaged packing or product will not be reimbursed or exchanged. This right of revocation is runing without penality. In case of an exchange of the product the re-shipping of the product will be made at the fees of the customer, In case of using the right of revocation, Lecyclo.com will do the maximum to reimburse the customer in a period of 15 days. However, dealing with the technical caracterisics of the items, this period could be extended to 30 days, Particularly when the item needs a technic verification. The customer will then be paid off by refunf on the credit card in case of payment by credit card, or by transfer in the other cases. If the product and its packaging have undergone damages and prevents the resale , supplementary expense would then be taken on the refund.

Article 16 : Force majeure

None of the 2 parts would have failed to his contractual obligations, if his execution has been delayed, impeded by a fortuitous case or a force majeure. Will be considered as fortuitous case or force majeure every irresistible act or circumstance , external of the parts, unpredictable, inevitable, independant of the volountier of the parts. Are considered as case of force majeure earthquakes, tempest, inundations...

Article 18 : Non renonciation

The fact for one of the parts not to prevail himself a failure by another part with any of the obligations aimed under the present general terms could not be interpreted for future like a renunciation of obligation in question.

Article 19 : Title

In case of difficulties of interpretation of the title of those clauses, or a particular clause, the title will be declared non existent.

Article 20 : Applicable law

The present general conditions are propounded to the French Law. In case of a litigation or complaint, the customer will talk first to Lecyclo.com to obtain a friendly solution. In an eventual second time, The customer can give his complaint to the competent bankruptcy court.

Article 21 : Informatics & Freedom

The informations that are asked to the consumer are necesary to the treatment of his order and can be communicated to the contractual partners of Lecyclo.com are involved in the treatment of this order. If the consumer doesn't want this comunication of his informations, he has to check in the case when he passes his order.
